Decision Making Process

The Decision Making Process is a staged process which will apply to instances where the Commission proposes the imposition of an enforcement measure or sanction. 

The Decision Making Process was approved by the Commission in March 2014 and replaced the Decisions Committee Process document dated January 2012.  The Decision Making Process was revised in September 2014 and again in October 2017. The latest iteration is released in an effort to further improve on proceedings and ensure that matters are dealt with expeditiously.  For the avoidance of doubt, all matters that are currently with a Decision Maker, whether that is a Senior Decision Maker or the Commissioners Decisions Committee, shall remain under the October 2017 Decision Making Process.  All matters that are yet to be referred to a Decision Maker will fall under the November 2019 document.

Each case will be approached based on its facts and by reference to the Decision Making Process.
